Terms of Use

These Terms and Conditions describe the terms applicable to the services and content offered through the “cybulskaart.eu” website and regulate the legal relations between and the client.

Access to the website is free of charge, the use of the website implies the unreserved acceptance of all the Conditions of Use. If you do not agree to these conditions, you must refrain from using this page.

The visit to the eCommerce site by the user must be done responsibly and in accordance with current legislation, good faith, these Conditions and respecting the intellectual and industrial property rights owned by MARTA CYBULSKA ART or any other natural or legal persons.

The use of any of the contents of the website for purposes that are or could be unlawful is totally prohibited, as well as the performance of any action that causes or may cause damage or alterations of any kind not consented to by MARTA CYBULSKA ART, to the eCommerce site or its contents.

Orders

Once an order has been placed, you will receive a message confirming receipt of the order as well as information about the shipment and billing of the order placed.

Payment method

The purchase of services or products through “cybulskaart.eu” allows the following forms of payment:

Payment by debit or credit card through a virtual POS terminal.

Prices

The prices of the products are those indicated in the description attached to them. All prices indicated in the product description are expressed either in the Polish zloty currency (PLN) or Euro currency (€) and include Value Added Tax (VAT).

Shipping Conditions

“cybulskaart.eu”  ships your products to Poland or to Spain.

The purchase is subject to the payment of shipping costs, at the buyer’s expense. Shipping costs will depend on the destination and the total amount of the order, the costs will be detailed throughout the purchase process and you will be able to check how much the shipping costs are before finalizing the purchase.

“cybulskaart.eu” will not be held responsible for delays in the delivery of orders for reasons not attributable to it, as well as for fortuitous events or force majeure.

Delivery will be made by a transport company.

Consumer Goods Warranty

As a customer, you are considered a consumer in accordance with Royal Legislative Decree 1/2007, of 16 November, which approves the revised text of the General Law for the Defence of Consumers and Users and other complementary laws (hereinafter, “TRLGDCU”).

Consequently, you have the right of withdrawal, which consists of you being able to cancel the contract entered into without the need to justify your decision during fourteen (14) calendar days from the receipt of the purchased good or from the conclusion of the contract if it is a provision of services.

You must express your intention to withdraw within the indicated period and proceed to return the product, refunding the price paid.

If you have problems with products or services purchased on this website, you can file a complaint through the European Union’s dispute resolution platform here. MARTA CYBULSKA ART reserves the right to refuse to accept the claim submitted through the platform.

Nullity and ineffectiveness of the clauses

If any clause included in these Conditions is declared totally or partially, null or ineffective, such nullity or ineffectiveness will only affect that provision, and these General Conditions will subsist in all other respects, and such provision will be considered not included.

Applicable law and competent jurisdiction

These conditions are governed in accordance with Spanish law. MARTA CYBULSKA ART and the User agree to submit any disputes that may arise in relation to the contracting of products or services subject to these General Conditions to the Courts and Tribunals of the User’s domicile.
